MEDIATION PROCESS

INITIATE MEDIATION

Please contact Kent via email or at (626) 250-2069 to schedule a date and time for your mediation. Please have a few possible dates available for your mediation.

MEDIATION LOCATION

Mediations are conducted online or in-person, depending on the preferences of the parties.

Online mediations are conducted via Zoom.

In-person mediations take place at a mutually agreed upon location, preferably an of the offices of one of the attorneys handling the litigation. If no office is available, Mr. Sommer can provide a neutral location.

SUBMISSION OF BRIEFS

The parties are encouraged to provide a written brief or statement at least 5 days before the mediation. These briefs are crucial to help Mr. Sommer facilitate settlement discussions.

Briefs should include: procedural background, case facts, status of discovery and relevant motions, damage evaluations, and any prior settlement offers or discussions.

THE MEDIATION SESSION

Kent's mediation approach is tailored to the unique needs of each case, ensuring that parties can reach mutually agreeable solutions in a constructive and efficient manner.

The mediation will usually involve private sessions with the each attorney and his/her client, but the mediation may include joint sessions as needed.

CONFIDENTIALITY

All parties sign a confidentiality agreement prior to the mediation. Mr. Sommer provides a confidential and impartial environment for all parties involved. Maintaining confidentiality is essential to the success of the entire process.
